Letter from US Senator Mark Dayton to Judge Joseph Wieners about Heartland

 

 

 

On March 7, 2005, the Heartland developer informed the MPCA of their intention to abandon the project in Preston.  On March 16, 2005, the MPCA withdrew the air emissions permit previously issued to Heartland.

The Minnesota Pollution Control Agency (MPCA) conducted environmental review of the proposed Heartland tire-burning plant.  Click to the following MPCA link to review all MPCA documents and information about Heartland:

SEMEP sued the MPCA to compel a full environmental impact statement (EIS) to be performed for the proposed Heartland tire-burning plant.  On February 17, 2004, Judge Joseph F. Wieners, Minnesota District Court, issued his decision and opinion ordering the MPCA to perform additional environmental review of the Heartland tire-burning plant.

Following Judge Wieners' first decision, SEMEP wanted to make sure Heartland could not begin building its tire-burning plant while the MPCA conducted further environmental review.  At SEMEP's request, Judge Wieners issued an order staying construction of Heartland.

On January 25, 2005, the MPCA Citizens Board met and ordered the MPCA to perform a full EIS and environmental review of Heartland.
